Non-Resident Owners and Occupiers Roll

A person who is enrolled to vote in State or Federal Elections outside of the Town but owns or occupies rateable property within the Town may claim eligibility to be placed on the Owners and Occupiers Roll and vote in local government elections. 

Enrolment of non-resident owners or occupiers is not automatic. To apply for enrolment onto the Roll, the appropriate Enrolment Eligibility Claim Form (detailed below) is to be completed and lodged with the Town by 57 days before the election day.

An individual may only enrol onto the roll once regardless of the number of properties owned or occupied within the Town. A body corporate may only nominate two people onto the roll regardless of the number of properties owned or occupied within the Town.

If you personally own rateable property in the Town but are not enrolled to vote at that property, you may be eligible to apply to the Roll. 

To apply to enrol as a owner or co-owner, complete the Form 2A - Enrolment Eligbility Claim - Owner or Co-owner.

If the property is owned by three or more people, complete Form 2C - Enrolment Eligibility Claim - Nomination By Group Of Owners/Occupiers

To apply to enrol as an occupier, you must submit a Form 2B – Enrolment Eligibility Claim – Occupier/Co-Occupier.

If the property is occupied by three or more people, you must also submit a Form 2C - Enrolment Eligibility Claim - Nomination By Group Of Owners/Occupiers

You must provide a copy of your lease, tenancy agreement or other legal instrument and any additional supporting evidence to support your claim at the time of enrolment. 

To be eligible to vote you must provide proof that:
  1. you have a right of occupation over rateable property (or part of) under a lease, tenancy agreement or other legal instrument;
  2. you have continuously occupied the rateable property under a lease or other legal instrument for at least 12 months prior to your claim and will occupy the property for at least the next three months;
  3. you have quiet enjoyment (exclusive occupation) of the occupied property;
  4. you are able to secure your occupied property from intruders;
  5. you genuinely operate or intend to operate your business from that property;
  6. you lease at least 10m2 of property (subject to a series of exclusions);
  7. you pay the minimum amount of rent for the property ($5,000 for 100m2 or more or $50 per m2 if less than 50m2 per annum); and
  8. are enrolled to vote in a State or Federal election outside of the Town. 

If a body corporate owns property in the Town of Claremont it may be eligible to nominate two people, who are not already enrolled to vote within the district, to the Roll. 

To nominate electors on behalf of a body corporate, complete all sections of:

  1. Form 2A - Enrolment Eligbility Claim - Owner or Co-owner; and
  2. Form 2D - Enrolment Eligibility Claim - Nomination by Body Corporate

If the property is owned by three or more parties, Form 2C - Enrolment Eligibility Claim - Nomination By Group Of Owners/Occupiers must also be completed. 

If a body corporate occupies property in the Town of Claremont it may be eligible to nominate two people, who are not already enrolled to vote within the district, to the Roll. 

To nominate electors on behalf of a body corporate occupier, complete all sections of:

  1. Form 2B – Enrolment Eligibility Claim – Occupier/Co-Occupier; and
  2. Form 2D - Enrolment Eligibility Claim - Nomination by Body Corporate

If the property is owned by three or more parties, Form 2C - Enrolment Eligibility Claim - Nomination By Group Of Owners/Occupiers must also be completed.
